§ 51.01 DEFINITIONS.
   For the purpose of this chapter, the words and phrases shall be defined as follows, unless the context clearly indicates or requires a different meaning.
   ABATEMENT. Any action taken to remedy, correct, or eliminate a condition within, associated with or impacting a drainage system, pursuant to §§ 51.32 or 51.33 of this chapter.
   APPEALS BOARD. The Stormwater Management Utility Appeals Board whose duties shall be pursuant to § 51.34 of this chapter. Council shall serve as the Appeals Board unless it shall by resolution designate another board. The City Manager or his designee shall serve as the executive secretary of the Appeals Board.
   APPROVED PLANS. Plans approved pursuant to § 51.19 of this chapter.
   ARCHITECT OR ARCHITECT, REGISTERED. A person holding a certificate under R.C. § 4703.06.
   AREA RANGE NUMBER (ARN). A number assigned by the Utility for the purpose of calculating stormwater management service charges, based on the total square footage of lots or parcels of real property, pursuant to §§ 51.26 and 51.28 of this chapter. Lots or parcels of between one and 2,000 square feet shall be assigned Area Range Number (ARN) 1. ARN 2 shall be used for those lots or parcels between 2,001 and 4,000 square feet, ARN 3 for lots or parcels between 4,001 and 6,000 square feet, and so on.
   (BMP) STORMWATER BEST MANAGEMENT PRACTICE. Schedules of activities, prohibitions of practices, maintenance procedures, and other management practices to prevent or reduce the pollution of surface waters of the state. BMPs also include treatment requirements, operating procedures, and practices to control runoff, spillage or leaks, sludge or waste disposal, or drainage from raw material storage.
   BUILDING CODE. The Building Code adopted in Chapter 152 of the City of Forest Park Code of Ordinances.
   BUILDING DEPARTMENT. The Building Department authorized by the Charter of the City of Forest Park or the Community Development Department.
   CITY. The City of Forest Park, Ohio and its authorized agents.
   CITY ENGINEER. A professional engineer designated by and representing the City of Forest Park, Ohio or his authorized agent.
   CITY MANAGER. The City Manager as provided for in Article IV of the Charter of the City of Forest Park, Ohio.
   COMMITTEE. The Stormwater Management Utility Advisory Committee consisting of a member of Council and four persons appointed by Council whose duties are specified in § 51.02 of this chapter.
   COMMUNITY DEVELOPMENT DEPARTMENT. The Community Development Department of the City of Forest Park, Ohio.
   COUNCIL. The City Council of the City of Forest Park, Ohio.
   COUNTY. The County of Hamilton, Ohio.
   DETENTION BASINS. A stormwater management practice that provides storage of stormwater runoff to attenuate flow rates during storm events to minimize downstream impacts associated with development and redevelopment, and which does not have a permanent pool and is designed to drain completely between storm events.
   DEVELOPER. A person, firm, partnership or corporation, which otherwise improves a specific parcel or tract of land, performs construction work of any kind in the "project area" as defined in this section or holds or is required to obtain a "permit" as defined in this section.
   DIRECTOR. The Director of the Stormwater Management Utility which shall be appointed by the City Manager as provided for in Article VI of the Charter of the City of Forest Park.
   DWELLING UNIT. A residential house, apartment or other living quarter on a single parcel of land.
   EMBANKMENT. Any act by which earth, sand, gravel, rock, or any other material is placed, pushed, dumped, pulled, transported or moved to a new location above the natural surface of the ground or on top of the stripped surface or cut and shall include the conditions resulting therefrom. The difference in elevation between a point on the original ground and a designated point of higher elevation on the final grade; a fill or the material used to make an embankment.
   ENFORCING OFFICIAL. The public official designated by Council or the City Manager to enforce the provisions of Chapter 51 of the Forest Park Code of Ordinances.
   ENGINEER, PROFESSIONAL. A person holding a certificate of registration under R.C. §§ 4733.14 or 4733.19.
   EROSION. The wearing away of the land surface by the action of wind, water or gravity.
   EXCAVATION. Any act by which earth, sand, gravel, rock or any other similar material is dug into, cut, quarried, uncovered, removed, displaced, relocated, or bulldozed and shall include the conditions resulting therefrom. The difference between a point on the original ground and designated point of lower elevation on the final grade; cut or the material removed in excavation.
   EXISTING. Present or in effect as of the time of the adoption of this chapter.
   GRADING. Any stripping, cutting, filling, stockpiling, or any combination thereof and shall include the land in its cut or filled condition.
   IMPERVIOUS SURFACE. A surface on or in a lot or parcel of real property which substantially reduces the rate of infiltration of stormwater into the earth.
   INSPECTOR. A person designated by and representing the City of Forest Park for inspection of stormwater related work to ensure conformance with the "approved plan," and the provisions of this chapter.
   INTENSITY OF DEVELOPMENT FACTOR (IDF). The runoff coefficient or percentage of impervious surface on or in a lot or parcel of real property, as used in § 51.27 of this chapter. Eight land uses are identified for purposes of this chapter, with an accompanying intensity of development factor ranging from 0.00 for vacant lands to 0.85 for commercial development. The numerical value for each such land use is based upon generally accepted engineering standards.
   MULCHING. The application of suitable materials on the soil surface to conserve moisture, hold soil in place, and aid in establishing plant cover.
   MUNICIPAL. Property or facilities owned by the city of Forest Park.
   NATURAL VEGETATION. The ground cover in its original state before any grading, excavation or filling.
   NOTICE. A written or printed communication conveying information or warning.
   ODOT. The Ohio Department of Transportation.
   ORDER. The whole or any part of the final disposition (whether affirmative, negative, injunctive, or declaratory in form) or any matter issued by the Director or City Manager or person designated by them pursuant to any provisions of this chapter.
   OWNER. Any person, business or organization that possesses real property.
   PERMANENT VEGETATION. Vegetation which produces long term vegetative ground cover such as bluegrass, tall fescue, crown vetch, and the like.
   PERMIT. The "stormwater management permit" required by this chapter.
   PERSON. Any person, firm or corporation (public or private), the State of Ohio and its agencies or political subdivisions and the United States of America, its agencies and instrumentalities, and any agent, servant, officer, or employee of any of the foregoing.
   PLAN. The "stormwater management plan" required by this chapter.
   PLANNING COMMISSION. the Planning Commission provided for in Article VII of the Charter of the City of Forest Park, Ohio.
   PREMISES. A lot or parcel and the buildings and improvements situated thereon.
   PRIVATE. Property or facilities owned by individuals, corporations, and other organizations and not by local, state, or federal government.
   PROJECT AREA. The land lying within the geographical limits of the tract(s) or parcel(s) under consideration and on which the work is to be performed.
   PUBLIC. Property or facilities owned by local, state, or federal governments.
   RETENTION BASINS. A stormwater management practice that provides storage of storm water runoff to attenuate flow rates during storm events to minimize downstream impacts associated with development and redevelopment, and which has a permanent pool to improve treatment of stormwater runoff and is never dry between storm events (also referred to as a wet retention basin or wet pond).
   SEDIMENT. Solid material both mineral and organic, that is in suspension, is being transported, or has been moved from its original site or origin by air, water, or gravity as a product of erosion.
   SEDIMENT BASIN. A barrier or dam built across a waterway or at other suitable locations to retain rock, sand, gravel, silt or other materials.
   SEDIMENT CONTROL PLAN. A plan required by an ordinance, rule, or regulation for controlling the movement of soils due to storm runoff created by construction activities.
   SLOPE. Slopes are expressed as a percentage of vertical difference in feet per 100 feet of horizontal distance or as a ratio of horizontal distance to vertical distance. For example, 5% means five feet vertical to 100 feet horizontal and 3:1 means three feet horizontal distance to one foot in elevation change.
   STORM, STORMWATER.  STORM and STORMWATER as used in this chapter are interchangeable terms.
   STORM SEWER, STORM DRAIN. A sewer or drain which carries stormwaters, surface runoff, street wash waters, and drainage, but which excludes sanitary sewage and industrial wastes, other than unpolluted cooling water. Storm sewers begin at the grating or opening where water enters the structure, through the sewer and conduits to the outlet structure where water enters a channel or natural watercourse.
   STORMWATER FACILITIES. Various drainage works that may include inlets, conduits, manholes, energy dissipation structures, channels, outlets, retention/detention basins, post-construction best management practices and other structural components.
   STORMWATER MANAGEMENT CODE. Chapter 51 of the City of Forest Park Code of Ordinances.
   STORMWATER MANAGEMENT DESIGN REGULATIONS. Hamilton County and the Hamilton County Stormwater District's most current stormwater design regulations which are adopted for the City of Forest Park.
   STORMWATER MANAGEMENT PLAN. The application, maps, plans, calculations and all other material required by this chapter or the stormwater management design regulations.
   STORMWATER MANAGEMENT SYSTEM. All man-made facilities, structures, and natural watercourses used for collecting, transporting, detaining, storing or disposing of stormwater to, through, and from drainage areas to the points of final outlet including, but not limited to any and all of the following: inlets, conduits and appurtenant features, canals, creeks, channels, catch basins, ditches, streams, gulches, gullies, flumes, culverts, siphons, retention or detention basins, dams, floodwalls, levees, and pumping stations.
   SUBDIVISION. The division or re-division of a lot, tract or parcel of land by any means into two or more lots, tracts, parcels or other divisions of land including changes in existing lot lines for the purpose, whether immediate or future, for lease, transfer of ownership or building or lot development. The name given to an area of land divided into lots including streets, walkways, easements, and the like.
   SWALE. A low-lying stretch of land which gathers or carries surface water runoff. See WATERCOURSE.
   TEMPORARY VEGETATION. Short term vegetative ground cover used to stabilize the soil surface until final grading and installation of permanent vegetation such as oats, rye or wheat.
   TOPSOIL. Surface soils and subsurface soils which presumably are fertile soils and soil material, ordinarily rich in organic matter or humus debris. Topsoil is usually found in the uppermost soil layer.
   TOTAL SQUARE FOOTAGE. The square footage of a lot or parcel measured or estimated by using the outside boundary dimensions, in feet, to obtain the total enclosed area, without regard for topographic features of the enclosed surface, as used in § 51.26 for the purpose of assigning an ARN to a lot or parcel of real property.
   The boundary dimensions in feet of the enclosed surface area may be established by any of the following methods:
      (1)    On site or photogrammetric measurements of the apparent outside boundary dimensions of the lot or parcel of real property made by the city or on its behalf; or
      (2)   Computation of the area using dimensions of lot or parcel of real property and/or existing area measurements which are set forth and contained in the records of the office of the County Recorder or Auditor.
   TYPICAL CLASS R PROPERTY. Property having an Area Range Number of 5. (Typical in Forest Park, 9,600 square feet.)
   UTILITY. The Stormwater Management Utility provided for by this chapter, which may be operated or organized as a department of the City of Forest Park, Ohio.
   VACANT LAND. A lot or parcel of land that is without any building, structure or improvement. It does not mean recreation, green or open space created around private or public facilities nor parcels connected or contiguous thereto for the same or similar uses. For the purposes of this chapter, vacant land has an IDF of 0.00.
   WATERCOURSE. A permanent or intermittent stream, river, brook, creek, channel, swale or ditch for water whether natural or manmade.
