§ 150.01 ADOPTION OF STATE BUILDING CODE.
   (A)   Codes adopted by reference. The Minnesota State Building Code, as adopted by the Commissioner of Administration pursuant to M.S. §§ 16B.59 to 16B.75, as they may be amended from time to time, including all amendments, rules and regulations established, adopted and published from time to time by the Minnesota Commissioner of Administration, through the Building Codes and Standards Division is adopted by reference with the exception of the optional chapters not included in division (B) of this section.
   (B)   Optional provisions. The following optional provisions identified in the most current edition of the State Building Code are adopted and incorporated as part of the Building Code of the city:
      (1)   1306, subp. 2, Special Fire Protection Systems, with option 1306.0020, subp. 2 and 1306.0030E, Option 2;
      (2)   1335, Floodproofing Regulations, parts 135.0600 to 1335.1200;
      (3)   2006 International Building Code, Appendix Chapter J (grading).
   (C)   Application, administration and enforcement. The application, administration and enforcement of the code shall be in accordance with the Minnesota State Building Code. This code shall be enforced by the Minnesota Certified Building Official designated by the city to administer the code.
   (D)   Permits and fees. The issuance of permits and the collection of fees shall be as authorized in M.S. § 16B.62, Subd. 1, as amended from time to time. Permit fees shall be assessed for work governed by the code in accordance with the fee schedule adopted by ordinance of the City Council. In addition, a surcharge fee shall be collected on all permits issued for work governed by the Code in accordance with M.S. § 16B.70, as amended from time to time.
   (E)   Violations. A violation of this section is a misdemeanor. The city may also institute appropriate actions or proceedings to prevent, restrain, correct or abate violations or threatened violations of this section.
