(A) Except as provided in division (K) of this section, no person shall fire or discharge any fire arm, BB gun, air gun or splat ball gun within the corporate limits of the city; provided, however, a BB gun or air gun may be discharged within a residence or other secure enclosure; and provided, further, that a fire arm, BB gun or air gun may be discharged within the Conservancy (C), Agriculture (A) and Rural Residential (RR) Districts and on and near to public waters in accordance with the regulations of the State of Minnesota Department of Natural Resources.
(B) Nothing in this section shall be construed to prohibit the possession of a firearm within the home or the discharge of the same when done in the lawful defense of person, property or family.
(C) Except as provided in division (K) of this section, no person shall fire or discharge a bow and arrow within the corporate limits of the city except in a designated area with a permit issued by the Chief of Police or his or her designee; provided, however, that a bow and arrow may be fired or discharged within a residence or other secure enclosure; and provided, further, that a bow and arrow may be discharged within the Conservancy (C), Agricultural (A) and Rural Residential (RR) Districts and on or near public waters in accordance with the regulations of the State of Minnesota Department of Natural Resources.
(D) No person shall keep, carry or have in his or her possession on any public street, upon the premises of another or in any public place any type of weapon having the personal assault characteristics of any sap, numchuck, blackjack, slungshot, slingshot, sand club, chain club, metal knuckles, shurikens, or yawara stick. For purposes of this division, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
NUMCHUCKS. Any device constructed of 2 solid cylindrical objects joined together on one end by a chain, rope, thong, or other such material.
SHURIKENS. Any metal device which has the shape of a multiple pointed star, each point being sharpened and primarily designed to be thrown.
YAWARA STICK. Any cylindrical shaped object which has spheres on both ends and measures less than 10 inches in length.
(E) No person shall do any of the following:
(1) Recklessly handle or use a firearm, other dangerous weapon or explosive so as to endanger the safety of another;
(2) Intentionally point a firearm or other dangerous weapon, whether loaded or unloaded, at or toward another;
(3) Display in public any toy, look-alike or imitation firearm without the red or orange tip required by Federal law at the time of manufacture.
(F) No minor under the age of 12 years shall handle or have in his or her possession or under his or her control, except while accompanied by or under the immediate supervision of his or her parent or guardian, any firearm, air gun or dangerous weapon of any kind for any purpose.
(G) No person shall:
(1) Without the parent’s or guardian’s consent, furnish a child under 14 yeas of age, or as a parent or guardian, permit the child to handle or use, outside of the parent’s or guardian’s presence, a firearm, air gun or dangerous weapon of any kind, or any ammunition or explosive;
(2) Furnish a minor under 18 years of age with a firearm, air gun, or dangerous weapon of any kind or any ammunition or explosive without the written consent of his or her parent, guardian, or the Chief of Police or his or her designee.
(H) No person shall transport a firearm by vehicle of any type, whether motorized or not, unless the firearm is:
(1) Unloaded and in a gun case expressly made to contain a firearm, and the case fully encloses the firearm by being zipped, snapped, buckled, tied, or otherwise fastened, and without any portion of the firearm exposed;
(2) Unloaded and in the closed trunk of a motor vehicle; or
(3) A handgun carried in compliance with M.S. §§ 624.714 and 624 715, as they may be amended from time to time.
(I) A person may not transport an archery bow in a vehicle of any type whether motorized or not unless the bow is:
(1) Unstrung;
(2) Completely contained in a case; or
(3) In the closed trunk of a motor vehicle.
(J) A peace officer is authorized and empowered to seize and confiscate and dispose of any weapons, firearms, guns, and/or bows and arrows possessed or used in violation of this section. Articles which have no lawful use may be summarily destroyed. All other articles confiscated may be retained for use by the Police Department or sold at public auction.
(K) Exceptions. The following exceptions to the application of this section shall apply:
(1) A weapon of any type may be discharged in the city by peace officers or animal control officers in carrying out their official duties.
(2) Firearms and archery equipment may be fired or discharged in an enclosed soundproofed building meeting the noise requirements of Chapter 96 of the City Code with a conditional use permit in the Limited Industrial Business (B-3), Industrial (I) and General Mixed Use (MU-2) zoning districts. Indoor firearms and archery ranges shall comply with all federal and state laws and regulations pertaining to the construction and maintenance of an indoor firearms or archery range in a new or existing building.
(L) Any person who shall violate the provisions of this section shall be guilty of a misdemeanor and, upon conviction thereof, shall be punished according to law.
