The city intends by this chapter to supplement the regulations imposed by the Minnesota Pollution Control Agency (“MPCA”) and to work in conjunction with that agency with regard to treatment and disposal of the contaminated soil. The city is a unique and special place because of its open spaces, woodlands, meadows, nature areas, and abundant lakes, rivers, streams, and wetlands. The city’s clean and natural environment is its major asset. Unless very carefully monitored and regulated, petroleum contaminated soil treatment and/or disposal is incompatible with the clean and natural environment that the city must preserve in order to ensure its viability as a place to live, work and grow. The already existing sources of petroleum related uses in the city provide a threat to the city’s environment. Accordingly, it has been determined by the city that it is not appropriate for contaminated soils to be treated and/or disposed of within the city except pursuant to the terms and conditions of this subchapter.
