§ 52.04 SEWER AVAILABILITY CHARGE. 
   (A)   There is imposed upon all sanitary sewer connections within the city a sewer core charge to reimburse the city for expenses incurred in the past and to be incurred in the future for making sewage treatment facilities available. The sewer core charge imposed shall be based upon the number of residential equivalent units as determined by the Metropolitan Council Environmental Services Division pursuant to the current Metropolitan Council Environmental Sewer Division’s Service Availability Charge Procedure Manual and the amount of the charge shall be as established in the city fee schedule found in Chapter 35 of the city code. If, after the initial connection charges are paid, additional building permits or new sewer connections are made, or when an increase of wastewater flow into the municipal sanitary sewer system is determined by the Metropolitan Council, charges shall be recalculated and any additional charges shall be paid.
   (B)   In addition to the sewer core charge, there is imposed a sewer access charge upon all new sanitary sewer connections within the city in the amount which is charged to the city by the Metropolitan Council Environmental Services Division for its sewer access charge.
   (C)   Payment of the sewer core charge and sewer access charge shall precede the issuance of a sewer/building permit under this chapter and shall be payable to the city.
   (D)   In all new developments with public utilities, there is imposed a trunk area sanitary sewer charge per net developable acre in the amount established in the city fee schedule found in city code Chapter 35. Net developable acres are defined as the gross area of the development less delineated wetlands and state or county road right-of-way. The trunk area sanitary sewer charge shall be paid to the city upon execution of the final plat for the development.
   (E)   The payments imposed by this section shall be deposited in the city’s sewer utility fund.
