§ 130.06 CONSUMPTION OF ALCOHOLIC BEVERAGES ON PUBLIC PROPERTY, PUBLIC RIGHTS-OF-WAY, AND PUBLIC PREMISES.
   (A)   No person may consume any intoxicants or possess an open container of any intoxicants on any public property, any public rights-of-way, or upon any premises open to the public unless licensed or permitted for that purpose by the State Liquor Control Commission. INTOXICANTS means liquors, non-legally prescribed controlled substances, inhalants, cannabis, psilocybin, that, when taken into the human body, can impair the person’s mental or physical faculties to a noticeable and perceptible degree.
   (B)   An officer may take into possession any property that is apparently being used in violation of division (A) above, as authorized by O.R.S. 471.610.
   (C)   The general penalty of violation of division (A) above is punishable under the provisions of § 10.99.
