(A) When an Enforcement Officer observes a vehicle parked on a public street or public property with three or more unpaid parking citations outstanding against the vehicle on which the Forest Grove Municipal Court has issued an Immobilization Order, the Officer may immobilize the vehicle and assess an immobilization fee set by Council resolution. An immobilized vehicle shall not be released until all outstanding parking fines and fees have been paid.
(B) If after immobilization, the parking fines and fees remain unpaid or no contact is made with the city within 24 hours the enforcement officer shall affix a pre-tow notice to the vehicle in accordance with § 74.06 after which time the vehicle may be impounded at the owner’s expense. An impounded or immobilized vehicle shall not be released until all outstanding fines and fees have been paid.
(C) Impoundment of a vehicle under this section does not preclude issuance of a citation for violation of any provision of this code.
