The following requirements, including published rules and regulations adopted pursuant hereto, shall govern the installation of water and/or sewer lines and/or street and alleys, the extension of existing lines, streets, and alleys, and the expansion of existing lines, streets, and alleys outside the limits of the Village of Forest.
(a) An application, on a form provided by the Village, shall be submitted to the Village Administrator by the applicant requesting such services. The application shall include a drawing which clearly shows the location of the proposed lines, number of taps required, type of service required, and, in the case of industrial and commercial users, group homes, apartments, and housing developments, the approximate daily usage of water and/or sewer services. Applications for streets or alleys will show the location of the proposed street or alley, width, depth, and type of road base, type and depth of surface, and whether curbs are to be installed.
(b) The Mayor shall review and submit each application to the Village Planning Commission for its approval or rejection. Such approval or rejection shall be forwarded to the Village Council for its approval or rejection. The applicant shall obtain an installation permit from the Village Administrator, evidencing approval by the Village Council, prior to beginning installation, extension, or expansion of water and/or sewer lines and/or streets and alleys. No application shall be accepted for construction that does not conform to the Village of Forest Zoning Ordinance No. 991 as amended.
(c) The applicant shall obtain and pay for all permits that may be required by Hardin County, the Board of Health, the Ohio Environmental Protection Agency, and the State of Ohio.
(d) The applicant shall agree in writing to allow the Village to inspect and/or maintain water and/or sewer lines and/or streets and alleys after installation.
(e) The applicant shall present to the Village a document evidencing an intent to annex the land to the Village as and when requested to do so by the Village.
(f) Unless the Village, at its option, chooses to use its personnel and equipment to install, extend, or expand the water and/or sewer lines and/or streets and alleys, the applicant shall be responsible for such installation, extension, or expansion and shall pay one hundred percent (100%) of the cost of installation, including materials and labor. All work to be done and materials to be used shall be in accordance with specifications formulated by the Village. The applicant shall furnish a sufficient bond to the Village in the amount of one hundred percent (100%) of the cost of installation.
(g) At its option, the Village, by vote of the Village Council, may cause bids to be obtained and use its personnel and equipment to extend or expand water and/or sewer lines and/or streets and alleys. The Village may require the applicant to furnish the materials necessary for installation. Additionally, at its option, the Village, by vote of the Village Council, may extend or expand water and/or sewer lines and/or streets and alleys beyond that requested by the applicant, which extension or expansion shall be at the Village's expense.
(h) The Village Administrator and/or the Water and Sewer Department Supervisor and/or Maintenance Supervisor shall inspect the installation on a regular basis to determine that the quality of work and materials used are in compliance with the specifications established by the Village
(i) Upon completion of installation and approval thereof by the Village, all water and/or sewer lines and/or streets and alleys shall become the property and responsibility of the Village.
