135.02  APPOINTMENT OF CHIEF; QUALIFICATIONS.
   (a)   The Village shall have a Marshal, designated the Chief of Police, appointed by the Mayor with the advice and consent of Council, who need not be a resident of the Village at the time of his or her appointment, but shall become a resident of the Village within six months after his or her appointment by the Mayor and confirmation by Council, unless such residence requirement is waived by ordinance, and who shall continue in office until removed therefrom as provided by Section 135.05 .
   (b)   No person shall receive an appointment under this section unless, not more than sixty days prior to receiving such appointment, he or she has passed a physical examination, given by a licensed physician, showing that he or she meets the physical requirements necessary to perform the duties of Village Marshal as established by Council.  The appointing authority shall, prior to making any such appointment, file with the Police and Firemen’s Disability and Pension Fund a copy of the report or findings of such licensed physician.  The professional fee for the physical examination shall be paid for by Council.
