(a) Zoning District Variances. The following procedures shall be followed in applying for a variance from the requirements of this Ordinance.
(1) The applicant shall apply for a Zoning variance to the Zoning Enforcement officer. The Zoning Enforcement Officer has thirty days to review the application and submit the application to the Board of Zoning Appeals.
(2) The Board of Zoning Appeals shall act on the applicant's appeal within thirty (30) days. If the Board of Zoning Appeals denies the request for a variance or fails to approve the request within thirty (30) days, then the applicant may appeal to the Council of the Village of Forest. The Village Council shall set a date to review the request and notify the applicant of such date. If the Village Council denies the request for a variance, the applicant may proceed with legal action in the Court of Common Pleas.
(b) Zoning District Changes. The following procedure shall be followed in applying for a Zoning District Change (Re - Zoning).
(1) The applicant shall submit the request to the Planning Commission of the Village of Forest. The applicant shall comply with the provisions of Section 1117.03(b)(6). The Planning Commission shall act on the request within thirty (30) days and make its recommendations to the Village Council.
(2) The Village Council of Forest shall review the recommendation of the Planning Commission. If the Council accepts the recommendation, the Council will have legislation prepared to amend this Zoning Ordinance. If the Village Council does not accept the recommendation, the applicant may proceed with legal action in the Court of Common Pleas.
