1117.06 ADMINISTRATIVE PROCEDURES.
   (a)    Zoning Permits.
      (1)    Requirements.
         *    Required in order to erect, construct, reconstruct, enlarge, replace, raze, or alter any building, structure, fence, sidewalk, or sign.
         •   Plans must be submitted to Zoning Enforcement Officer.
         •   Zoning Enforcement Officer shall notify Harding County Health Department of each permit.
      (2)    Provisions of Utility Services.
         *     No property may have initial utilities before Zoning Permit is issued.
      (3)    Application for Zoning Permit.
         *    Submitted to Village Clerk or Zoning Enforcement Officer.
         *    Zoning Enforcement Officer reviews information for one (1) copy of drawing, location/zone of lot, location, size, and height of building, existing or intended use of structure on land, number of families or dwellings each building is designed for.
      (4)    Utility Buildings.
         *    Required if foot print greater than 100 ft. sq.
         *    Must be 3 feet from back and side of property line, and 30 ft. from front property line.
         *    Time limit to complete building is six (6) months from issuance of permit.
   (b)    Text Amendments and Changes of Zoning Districts.
      (1)    Amendments to the Zoning Ordinance or changes of Zoning Districts on the Official Zoning District Map shall be made in accordance with the provisions in the Ohio Revised Code, Chapter 713.
      (2)    Changes shall be considered by the Village Planning Commission and Village Council if the request for change meets one or all of the following conditions.
         A.   Error in the Zoning Ordinance text and/or designations on the Zoning District Map.
         B.   In accordance with or more appropriate conformance to the Village Land Use Plan.
         C.   Change in area conditions.
         D.   Legitimate requirement for additional land area for Zoning District.
      (3)    Zoning District Map amended. The Village Planning Commission and Village Council shall not approve any request (excluding area in roads and highways) containing less acreage than the minimum specified for each Zoning District in Chapter 1109.
   (c)    Non-conformities: Buildings, Uses, and Lots.
      (1)    There may exist non-conformities which were lawful before the Zoning Ordinance was passed or amended, but are now prohibited, regulated, or restricted such as:
         A.    Buildings and Structures.
         B.    Uses of Land and Structures.
         C.    Lots of Record.
      (2)    Non-conforming buildings and structures.
         A.    Shall be permitted to exist only until they are removed.
         B.    Items in A above destroyed by fire or other acts of God may be reconstructed within existing dimensions one (1) time. Reconstruction shall begin within six (6) months of the destruction of same. This section does not apply to family dwellings.
         C.    Buildings or structures existing prior to the effective date of this Ordinance or    Amendment may be maintained and/or repaired.
      (3)    The non-conforming use of a building, structure, or land that is discontinued for more than eighteen (18) months may not be resumed.
      (4)    Non-conforming lots of record. In any zoning district in which single family dwellings are permitted, a single family dwelling and accessory buildings may be erected on any single lot of record which was in existence prior to the effective date of this Zoning Ordinance. Yard requirements and provisions of the district shall apply. Variance of yard requirements shall be obtained only through the Board of Zoning Appeals.
   (d)   Razing of Structures: Requirements.
      (1)    Zoning Permit is required.
      (2)    A fee is not required.
      (3)    Burying and/or burning of debris is not permitted.
      (4)    EPA guidelines/regulations must be followed.
      (5)    All utilities must be disconnected prior to beginning razing.
      (6)    Owner or Contractor will be held responsible for any damage occurring to Municipal property or utilities.
