(A) An interested party may protest the award of a bid, the proposed award of a bid, or a solicitation for supplies, services, professional services, or construction by filing with the City Administrator, within ten days of the award of the bid or contract, the following information in writing:
(1) Name, address, and telephone number of the protester;
(2) Signature of the protester or the protester’s representative;
(3) Identification of the bid under protest;
(4) A detailed statement of the legal and factual grounds of the protest, including copies of relevant documents; and
(5) The form of relief requested.
(B) The City Administrator shall have authority, prior to the commencement of an action in court concerning the controversy, to settle and resolve a protest by an aggrieved bidder, offeror, or a contractor, actual or prospective, concerning the solicitation or award of a bid or contract. If the protest is not resolved by mutual agreement, the City Administrator shall issue a decision in writing within ten calendar days. The decision shall:
(1) State the reasons for the action taken; and
(2) Inform the protester of the right to request a review of the decision by City Council.
(C) If the protestor requests a review by City Council the matter shall be placed on the agenda for City Council consideration at the next Council meeting scheduled after the request is received.
