(A) The Director of Public Works may grant a variance from the requirements of this subchapter if exceptional circumstances exist such that strict adherence to the provisions of this subchapter will result in unnecessary hardship to the owner, operator, or other person and will not fulfill the intent of this subchapter.
(B) A written request for a variance shall be required and shall be submitted in accordance with the Manual.
