§ 99.03 PERMISSION REQUIRED FOR CERTAIN ACTIONS.
   (A)   It shall be unlawful to commit any of the following acts with respect to trees on the public right-of-way or on public property without written permission from the Urban Forest Commission through the Public Services Department.
      (1)   Cut, prune, trim, break, injure, alter or remove any tree; or cut, unduly disturb, or interfere with the root zone of a tree(s) except as provided in this chapter.
      (2)   Fasten any object, rope, wire, sign, insulator, or other device to a tree(s).
      (3)   Install, remove, or injure any guard or device placed to protect tree(s).
      (4)   Close or obstruct any open spaces about the base of a tree or trees to permit the access of air, water, and fertilizer to the roots of such tree(s).
      (5)   Cut or compact any roots within the drip line of any tree or any roots four inches or more in diameter at any location on public right-of-way or on public property.
      (6)   String or bury wires or lines through a public park.
   (B)   The Urban Forest Commission, through the Public Services Department may grant written permission for any activity in division (A) of this section if it is in the public interest to do so, and is not likely to injure a tree on the public right-of-way or public property. Any person, firm, or corporation causing damage to tree(s) on the public right-of-way or on public property shall be held liable for damages.
