§ 41.01 AUTHORITY TO DECLARE A STATE OF EMERGENCY.
   (A)   If the Mayor is absent from the city or unable to act, in the event of the occurrence or threatened or impending occurrence of any of the situations or events contemplated by KRS 39A.010, 39A.020 or 39A.030, the following persons are hereby designated with authority to declare in writing that a state of emergency exists and thereafter to exercise, for such period as the state of emergency exists or continues, the emergency powers set for in KRS 39A.100(3): the City Coordinator; or, in his or her absence or inability to act, the Chief of Police; or in his absence or inability to act, the Chief of Fire/EMS Department.
   (B)   The authority hereby delegated to such designees shall be subject to any orders of the Governor of the Commonwealth of Kentucky.
