§ 53.99 PENALTY.

   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.

   (B)   Any user violating any provisions of §§ 53.02 through 53.14 shall become liable to the town for any expense, loss, or damage occasioned by the town by reason of such violation.

   (C)   Failure by the property owner to replace the existing building lateral sewer, per § 53.04, within 60 days shall constitute a violation of this subchapter and shall subject the owner to a $25 per day fine to be added to the owner’s monthly utility charges.

   (D)   Notwithstanding any other section of this subchapter, any user which is found to have violated any provision of this subchapter, permits, and orders issued hereunder or any other pretreatment requirement shall be fined in an amount not to exceed $500. Such fines shall be assessed on a per violation, per day basis. In the case of monthly or other long-term average discharge limits finds shall be assessed for each business day during the period of violation.
