§ 35-108 SAME — FORM OF SUBPOENA BY CIVIL SERVICE COMMISSION.

   For the purposes of enforcing Section 5-202 of the Charter of the City of Flint, subpoenas may be issued by the Civil Service Commission in the name of the people of the City of Flint and shall be signed and sealed by the Director of the Civil Service Commission pursuant to the rules of the Civil Service Commission.

§ 35-109 SAME — REFUSAL TO COMPLY WITH SUBPOENA.

   It shall be unlawful for any person served with a subpoena issued by the Civil Service Commission as provided in § 35-108 to appear and testify or to produce books, papers and other evidence in the course of an investigation or proceeding pursuant to Section 5-202 of the Charter, to refuse or neglect to appear or testify or produce the books, papers and other evidence as commanded in the subpoena. The provisions of this section are cumulative and are not intended to have any effect on the power of the Civil Service Commission to take other action to compel the production of evidence.

§ 35-110 CONDITIONS UNDER WHICH PERSON HAVING A FAMILY RELATIONSHIP TO DEPARTMENT OR DIVISION HEAD MAY BE EMPLOYED.

   (a)   No person acting as the appointing authority for any department or division within the City of Flint shall select for appointment to any personnel position occurring within the department or division any person having a direct family relationship to the person acting as the appointing authority.

   (b)   No person acting as the appointing authority for any department or division within the City of Flint shall select for appointment to any personnel position within the department or division any person having a direct family relationship to any other department or division head without first having the appointment reviewed and approved by the Standards of Conduct Board for the City of Flint.

   (c)   For the purposes of this section, DIRECT FAMILY RELATIONSHIP shall mean spouse, sibling, children, stepchildren, parents, stepparents, grandparents, parents-in-law, sons-in-law, daughters- in-law, grandchildren, niece and nephew.

   (d)   Any person making application for employment with the City of Flint shall disclose upon the application any family relationship to any other person currently employed by the City of Flint.

§ 35-111 CRIMINAL HISTORY BACKGROUND CHECKS OF ALL EMPLOYEES AND VOLUNTEERS REPRESENTING THE CITY OF FLINT AT THE BERSTON FIELD HOUSE, BRENNAN COMMUNITY CENTER, HASKELL COMMUNITY CENTER, HASSELBRING SENIOR CENTER, AND PIERCE COMMUNITY CENTER.

   The purpose of this section is to safeguard City residents and City-owned property.

   (a)   Individuals subject to criminal background checks:

      (1)   An applicant, seeking to engage in City employment at City of Flint community centers; and

      (2)   An applicant, seeking to engage in volunteerism with the City of Flint, acting as an agent on behalf of the City of Flint.

   (b)   Applicant shall submit his or her fingerprints, along with the appropriate fees for local, State and national criminal background checks.

   (c)   Upon receipt of the fingerprints and the appropriate fees, the City of Flint Police Department shall:

      (1)   If no disqualifying conduct is found therein, transmit sets of fingerprints to the Human Resources Department for retention in the appropriate application file; or

      (2)   If disqualifying conduct is found therein, submit the fingerprints to the Michigan State Police and the Federal Bureau of Investigation for a comparison with statewide and nationwide records. The results of the Michigan State Police and Federal Bureau of Investigation checks shall be returned to the Flint Police Department, which shall transmit the results to the Human Resources Department for retention in the appropriate applicant file.

   (d)   The City of Flint shall render its decision based upon the results of the criminal background check and communicate whether or not the applicant is eligible to volunteer or be employed at a City of Flint community center.

   (e)   In rendering a fitness determination, the City of Flint Human Resources Department will decide whether the applicant has been convicted of, or is subject to pending indictment for a crime that bears upon his or her ability or fitness to serve in that capacity.

   (f)   An applicant may request and receive a copy of his or her criminal history record information from the City of Flint Human Resources Department. Should the applicant seek to amend or correct his or her record, he or she may contact the Michigan State Police and/or the Federal Bureau of Investigation for records from other jurisdictions maintained in its file.
