§ 90.99 PENALTY.
   (A)   Any person violating any provision of this chapter for which no specific penalty is prescribed shall be subject to § 10.99 of this code of ordinances.
   (B)   Any tree expert who violates § 90.04 shall, upon conviction, be fined not less than $50 nor more than $200 for the first offense; and not less than $200 nor more than $500 for subsequent offenses. In addition, if the village has disposed of tree waste placed for disposal in violation of § 90.04, the defendant shall be ordered to reimburse the village for the cost of collection.
   (C)   (1)   Failure to comply with any requirement of § 90.48 shall be subject to a fine of no less than $300 and no more than $750 plus court costs. A separate offense shall be deemed committed upon each day during which a violation occurs or continues.
      (2)   The failure to abide by § 90.48 shall be considered a basis for the village requesting and obtaining an administrative search warrant to enter a building for health, safety, and general welfare purposes, to inspect for section violations and nuisance conditions, to treat and remediate any nuisance conditions, or as a basis to seek any equitable remedy.
      (3)   The failure to abide by § 90.48 shall be considered a basis for the village filing an action to remediate a nuisance.
   (D)   Any owner or responsible party receiving a notice of violation who does not remedy the nuisance within seven calendar days shall be guilty of a violation of §§ 90.60 through 90.63. Any person or party in violation of the provisions hereof shall be subject to payment of a fine of not less than $150 nor more than $750 for each offense. If the violation persists beyond seven days after the original notice was mailed, then each day the violation occurs or continues shall be deemed a separate offense. Upon expiration of the seven-day period following the issuance of notice, the village may file a complaint in County Circuit Court for an section violation or for other judicial relief.
