957.10 PERFORMANCE STANDARDS, DUTIES, PROHIBITIONS AND RECORDS.
   (a)   Daily Inspections. Each ambulance is to be inspected, using standard form for that purpose, every day before it goes into service in response to emergency calls in the City of Findlay. Records of daily inspections must be kept for one year. Such records must be produced when applying for annual license renewal or upon demand by the Safety Director.
   (b)   Every person operating an ambulance in response to emergency calls for service within the City of Findlay must demonstrate familiarity with the City’s streets and buildings.
   (c)   Response Time Standard. All emergency responses within the City of Findlay shall be performed as safely and expeditiously as possible. All emergency response times within the City of Findlay shall be within (8) eight minutes for Basic Life Support [BLS] and (12) twelve minutes for Advanced Life Support [ALS]. The City shall, in its sole discretion, evaluate justifications for any exceptions to the response time standards in each instance of deviation from the standards.
      (1)   Providers must keep records of all response times during every quarter of the year during which the ambulance/EMS provider is licensed to operate in the City of Findlay. Such reports must be provided to the Safety Director within 10 days after the close of a calendar quarter. Such records shall also be provided to the Safety Director on demand.
      (2)   Emergency runs and response times shall be kept by the licensee on a database and made available to the Safety Director on demand.
      (3)   In the event that an emergency call is not responded to within the standards outlined in this Section, a Variance Report shall be completed and submitted to the Safety Director within 2 business days after the incident. Such report will be used to explain the reason[s] for deviation from the standard response times.
      (4)   Possible deviations from the standards that could excuse the provider from sanctions include inclement weather, construction and road closures, disasters, and other unforeseen circumstances. These deviations must be fully described in the Variance Report.
      (5)   The failure of the ambulance/EMS provider during two consecutive quarters to complete 90% of its emergency calls within the response time standards is grounds for suspension or termination of the license. However, the City may, in its sole discretion, allow the ambulance company two additional quarters to improve the response times to comply with the standards described in this Section. Notwithstanding anything to the contrary in this Chapter, no penalty shall be assessed in the event that the licensee provides evidence that is reasonably satisfactory to the City that the licensee acted promptly and reasonably, given the particular facts and circumstances from which the penalty in question arose.
      (6)   The actual time that a licensee receives a 911 emergency request for service, and all other response times, must be recorded on an Ambulance Report Sheet. Response time begins at tone-out and ends when the ambulance arrives on the scene.
   (d)   Reporting Requirements. In addition to other records production requirements recited in this Chapter, the following must be maintained by licensee and made available to the City upon demand of the Safety Director:
      (1)   Copies of licensee’s Ohio Workers’ Compensation certificate and related documents, showing that the licensee is a compliant employer pursuant to Ohio statute and rules.
      (2)   Complete copies of Certificates of Liability, naming the City of Findlay as an additional insured, on licensee’s liability insurance policies or contracts of insurance, including all declaration pages and endorsements.
      (3)   Copies of all vehicle inspection reports performed by the City pursuant to this Ordinance.
      (4)   Copies of all daily logs and run reports, with run times as they pertain to licensee’s work under this Chapter, but protected information, such as the name of the patient and residence or other address, shall not be disclosed unless licensee has an executed release from the patient to provide the information.
      (5)   Copies of all disaster planning and disaster aid agreements.
      (6)   Copies of licensee’s health and safety protocols and other personnel and operational policies, including, but not limited to, documentation of employee safety training, such as HazMat, Infection Control, Emergency Vehicle Operation, and the like.
      (7)   Copies of all written protocols established as required by this Chapter and applicable Ohio law.
      (8)   Copies of licensee’s drug licenses for the vehicles based in Hancock County.
      (9)   Copies of continuing education files for licensee personnel based in Hancock County.
      (10)   Copies of licensee’s insurance company’s correspondence regarding review of driving records of licensee employees based in Hancock County.
      (11)   Daily log of all 911 calls [emergency and urgent] and runs, as described at Section 957.09(e), below.
      (12)   Copies or other suitable documentation of complaints from the public, users of licensee’s services, or City personnel, descriptions of each investigation, and disposition of each complaint received during the calendar year preceding the application for new or renewed license.
      (13)   Monthly notification of employee roster changes.
   (e)   Separate Records Requirement. Licensee ambulance/EMS provider[s] shall keep and maintain separate records for the operation of its emergency ambulance services within the corporate limits of the City of Findlay, and not combine such records with records of any other businesses or operations. These records shall be promptly made available on demand of the City:
      (1)   Daily logs and ambulance reports for all 911 responses and any other emergency response within the City of Findlay.
      (2)   Full records of response times include: the time when the call was received and dispatched; the time the ambulance arrived on the scene; the time the ambulance departed the scene for the hospital or to clear from the scene; the time the ambulance arrived at the hospital; the time the ambulance cleared from the hospital.
