957.02 GENERAL TERMS.
   (a)   Definitions. For purposes of this chapter, the following definitions apply:
      (1)   “Ambulance” has the same meaning as at 4766.01(D) of the Ohio Revised Code. Such ambulance is to be fully equipped to provide Advanced Life Support [ALS] care pursuant to all applicable statutes, rules, regulations, and medical protocols; and such ambulance is to be staffed with a minimum of one certified EMT-P and one EMT-B at all times.
      (2)   “Ambulette vehicles” used primarily for transporting private patients not treated in response to an emergency call for service have the same meaning as at 4766.01(E) of the Ohio Revised Code, and are not subject to the requirements of this Chapter.
      (3)   “Advanced Life Support” [ALS] means treatment as described in section 4765.39 of the Ohio Revised Code, and that which an EMT-B is certified to perform. ALS includes the services of Basic Life Support [BLS] and advanced emergency care: intravenous therapy; endotracheal airway; anti- shock trousers; cardiac monitor [EKG]; cardiac defibrillation; drugs; relief of pneumothorax, and other invasive procedures and services.
      (4)   “Basic Life Support” [BLS] means treatment described in §4765.37 of the Ohio Revised Code, and that which an EMT-B is certified to perform. This definition includes primarily transportation, first aid, CPR, and any needed administration of oxygen.
      (5)   “Intermediate Life Support” [ILS] means treatment described at §4765.38 of the Ohio Revised Code, and that which an EMT-I is certified to perform.
      (6)   “Emergency Medical Service” means any of the services described in sections 4765.35, 4765.37, 4765.38, and 4765.39 of the Revised Code that are performed by first responders, emergency medical technicians-basic, emergency medical technicians-intermediate, and paramedics. “Emergency Medical Service” includes such services performed before or during any transport of a patient, including transports between hospitals and transports to and from a fixed wing or rotor medical aircraft.
      (7)   “Emergency” means the sudden, unexpected, or impending situation that may cause injury, loss of life, damage to property, and /or interference with the normal activities of a person or firm and which therefore requires immediate medical attention and remedial action.
      (8)   “Emergency Medical Technician – Basic” [EMT-B] has the same definition as at §4765.01(B) of the Ohio Revised Code.
      (9)   “Emergency Medical Technician – Intermediate” [EMT-I] has the same definition as at §44765.01(C) of the Ohio Revised Code.
      (10)   “Emergency Medical Technician – Paramedic” [EMT-P] has the same definition as at §4765.01(D) of the Ohio Revised Code.
      (11)   “First Responder” means an individual who holds a current, valid certificate issued under section 4765.30 of the Revised Code to practice as a first responder.
      (12)   “Response time” means a common unit of measurement from receipt of the emergency call from dispatch until an EMS unit arrives on scene.
      (13)   The City of Findlay hereby adopts all definitions recited at §§4765.01 and 4766.01 of the Revised Code, except as such definitions are included in this section above.
   (b)   General Requirements. Any person or entity seeking to be licensed to operate an ambulance/EMS in response to emergency calls for service within the corporate limits of the City of Findlay must meet or exceed the requirements described in this Chapter.
      (1)   Legal relationship. All ambulance/EMS providers operating within the corporate limits of the City of Findlay, that respond to emergency calls for service, are an independent provider and not an agent of the City of Findlay
      (2)   Independent Provider Responsibilities. Except where otherwise limited by this Chapter, the independent provider shall have the sole duty, responsibility, control, and right to control its agents and employees, including, but not limited to, recruiting, hiring and training of employees. The provider will meet all federal and state health and safety requirements and comply with Medicaid and Medicare provider requirements.
      (3)   Any person or entity who applies for licensure as an ambulance/EMS provider shall furnish satisfactory evidence regarding their ability to provide the emergency medical services described in this Chapter.
      (4)   The ambulance/EMS provider shall comply with all applicable Ohio law and in particular Chapter 4766 of the Ohio Revised Code and the Ambulance Licensing Board. The provider shall comply with all applicable OSHA regulations regarding Bloodborne pathogens.
      (5)   The provider shall establish and provide evidence of a working relationship or agreement in which a credentialed member of a local hospital medical staff shall serve as the medical director for the provider[s]. The medical director shall determine the appropriate standards of quality and care provided by the ambulance/EMS provider[s]. The medical director shall ensure that provider[s] maintain appropriate and relevant licenses and certifications required by state and federal statute.
      (6)   Except as otherwise provided at Section 957.10 of this Chapter, a violation of federal, state or local statute, ordinance or regulation shall be considered to be a violation of the license granted pursuant to this Chapter, which shall allow the City of Findlay the right to take any remedial action, to include license suspension, or revocation as deemed appropriate.
      (7)   Except as otherwise provided at Section 957.10 of this Chapter, if there is reasonable cause to believe that the provider violated the terms of this Chapter, the City may immediately suspend or give notice of its intention to suspend or revoke the providers license to respond to 911 emergency calls. Such notice shall be in writing, delivered to the ambulance/EMS provider’s principal place of business. In such event, the provider shall be permitted to request a hearing on the matter with the Safety Director and Medical Director.
      (8)   Any person or entity licensed pursuant to this Chapter shall respond with a minimum of at least one ambulance unit to any reported structure fire occurring within the corporate limits of the City of Findlay, 24 hours per day, seven days per week. The responding ambulance/EMS unit shall remain at the fire scene until released by the Findlay Fire Department Incident Commander. Response to such fires shall be at the expense of the provider. The ambulance/ EMS provider shall also provide emergency medical treatment to fire fighters and police officers on scene as needed.
      (9)   If more than one provider is licensed pursuant to this Chapter, they shall be assigned to respond to emergency calls on a rotating basis by week. The City of Findlay shall determine the rotation and communicate such schedule, and any alteration of it, to all ambulance/EMS providers licensed to operate within the corporate limits of the City of Findlay. The provider who is responsible for responding to emergency calls for service during the 7–day rotation period must respond to all such calls.
      (10)   The Findlay Police Department shall be in command of all motor vehicle accident scenes and the Findlay Fire Department shall be in command of all Fire scenes in which an ambulance/EMS provider responds.
