523.09 VIOLATIONS.

(a) Owner Liability. No person or organization who or which owns, manages, operates or otherwise controls the use of any establishment subject to the restrictions of this chapter shall fail to comply with its provisions. No violation of this section shall be presumed solely on the basis of a violation of Section 523.09(b).

(b) Patron/Employee Liability. No patron or employee of an establishment described in Section 523.01 of this chapter shall smoke in any area restricted by this chapter.
