(A) No person shall cast, throw, or fire any squib, rocket, cracker, torpedo, grenade, cap, cartridge, or other combustible fireworks of any kind in the city, nor shall any person exhibit or have in his or her possession with intent to give away or sell within the city any squib, rocket, cracker, torpedo, grenade, cap, cartridge, or other combustible fireworks of any kind; provided, however, that this section shall not apply to the sale of any such article or articles by wholesalers to each other or to the sale of any such articles at wholesale to merchants conducting business entirely without the above described bounds of the city, or to the sale by wholesalers for public or private demonstration as provided for below.
(B) Nothing in this section or any other ordinances of the city shall be construed to prevent the sale, storage, or use of railroad track torpedoes or other signaling devices used by railroads, nor to the sale, storage, or use of flashlight composition by photographers or dealers in photographic supplies, nor to the firing or discharge of any pyrotechnic devices at a state licensed sanitary landfill for the purpose of controlling or abating nuisances caused by birds or other animals. Further, nothing contained herein shall prevent any public or private demonstration of fireworks of any kind if conducted under proper police supervision after application made and permit issued by the City Council for that demonstration. Any such permit application may be granted in whole or in part, denied, or issued with conditions, restrictions, or requirements deemed appropriate by the City Council in its sole discretion.
