§ 130.098 SETTLEMENT OF VIOLATIONS PRIOR TO SUITE BEING FILED; MINIMUM FINES.
   (A)   A person accused of violating a section of this code set forth in the city’s fine schedule as described in § 130.100 may be permitted to pay the minimum fine which is set forth in the city’s fine schedule as described in § 130.100 as settlement of such violation if payment is made within the time and in the manner set forth in division (C) of this section.
   (B)   Any officer or employee of the city who has been designated as a “peace officer” who issues a notice to appear to a person for an offense under this code for which the minimum fine is set forth in the city’s fine schedule as described in § 130.100 shall indicate on such notice to appear whether the person may pay the minimum fine set forth in such fine schedule as described in § 130.100 as settlement of such violation. Among other aggravating circumstances, a person should generally not be permitted to settle a violation of this code set forth in the city’s fine schedule as described in § 130.100 if such person has settled or been convicted of any violation of an ordinance of the city within the most previous two-year period.
   (C)   Payments in settlement of violations set forth in the city’s fine schedule as described in § 130.100 shall be made within 14 calendar days after the date that the notice to appear was issued to the person accused of such violation. A payment shall be considered made within such 14 calendar days if the payment is actually received by the city by 5:00 p.m. on the fourteenth day following the date the notice to
appear was issued. Payments shall be made by cash or certified check, money order or cashier's check made payable to the city, or by other monetary means under such conditions as the City Manager shall specify.
   (D)   If a person pays the minimum fine pursuant to this section, then no complaint charging the person with the particular violation shall be filed in the circuit court.
   (E)   The minimum fine for those violations listed in the city’s fine schedule as described in § 130.100 shall be as set forth in § 130.100 in lieu of the
minimum fine set forth in other provisions of this code.
