(a) Whenever the grade of any property is changed the person, firm or corporation making the change shall comply with the following rules and regulations:
(1) When the terrain above the level of the sidewalk is raised, then the person, firm or corporation changing the grade or disturbing the former condition of the terrain shall take measures to protect the washing down of silt, mud or other deleterious matter onto the sidewalk or public thoroughfare.
(2) Measures taken to prevent such wash down shall include, but are not limited to, the digging of a trench of a depth of at least six inches and a width of at least eight inches at the place where the terrain has been changed; and providing masonry or wooden fencing; or any other safeguards required by the Building Commissioner.
(b) Except during periods of actual construction work relating to the excavation in question, all excavations, whether on private property or the public thoroughfare, shall be covered or surrounded by a fence that takes an axial thrust of at least forty pounds and in addition, shall be lighted by flares, lanterns or other illumination as may be required by the Building Commissioner.
(c) Fencing permitted in subsections (a) and (b) hereof shall be eight-inch gauge wire fencing and any other fencing approved by the Building Commissioner.
(d) It shall be the obligation of the person, firm or corporation performing the construction, building or excavation work, to clean all silt, mud and deleterious material from the sidewalks and streets after each work day. This obligation shall not be limited to sidewalks and public thoroughfares immediately adjacent to the construction area, but shall extend to the cleaning of all sidewalks and public thoroughfares where the construction, silt and mud have been conveyed.
