If the owner, occupant or any other person in charge of such premises fails to comply with the requirements of this chapter, then the City may enter upon such premises and remove any and all obstructions from any drains, ditches, swales or other surface water conductors, and re-grade the surface of such premises to the finished grade line heretofore established, if necessary, and the City shall not be liable in damages of any kind or nature to such premises as a result of this work.
