(a) Whoever violates any provision of this chapter on a first offense shall be guilty of a misdemeanor of the third degree.
(1) Fines for misdemeanors of the third degree shall not be more than five hundred dollars ($500.00)
(2) Terms of imprisonment for misdemeanors of the third degree shall not be more than sixty days.
(b) If the offender has been previously convicted of any violation of this chapter, such second or subsequent offense shall constitute a misdemeanor of the second degree.
(1) Fines for misdemeanors of the second degree shall not be more than seven hundred and fifty dollars ($750.00).
(2) Terms of imprisonment for misdemeanors of the second degree shall not be more than ninety days.
