1305.01  REGISTRATION REQUIREMENT.
   (a)    No person, corporation, partnership, firm or other business association acting in the capacity of a contractor shall work at the trade or occupation of building, constructing, erecting, altering, repairing, painting, moving or demolishing any building or other structure, or do landscaping, tree surgery or tree forestry on the site thereof or any other site, or do any plaster work, mason work, brick laying, roofing work paving, fencing, unless such person, corporation, partnership, firm or other business association has been duly registered as a contractor with the Division of Building.
   (b)    No provision of this chapter shall be interpreted to require that a person, firm or corporation who is an owner or lessee of premises shall be registered to perform work upon such premises owned by such person, firm or corporation. Persons employed by the owner of the property in the capacity of a Building Custodian shall not be required to register or be otherwise subject to any provisions of this chapter. Such work shall be done in conformity with the provisions of the applicable building codes and no work shall be done unless all permits, inspections and approvals required by the applicable provision of the Building Code as secured.
   (c)    "Contractor", for the purpose of this chapter means any person, corporation, partnership, firm or other business association or any combination of the foregoing, who performs any work specified above for the consideration evidenced by an oral or written agreement. "Contractor", for purpose of this chapter, shall also mean any person, firm, corporation or other business association which negotiates a contract either written or oral for any work specified above, but does not perform physical labor to complete the work as set forth in the contract. No corporation, partnership, firm or other business associates shall engage in work for which a Certificate of Registration is required, unless at least one responsible member, officer or employee of such corporation, partnership, firm or other business association has been registered pursuant to this chapter. "Contractor" for the purpose of this chapter shall be limited to only those "contractors and sub-contractors" who by the nature of their work are required to obtain a permit for such work through the City of Fairview Park. All work performed by such corporation, partnership, firm or other business association shall be under the direct supervision of the registered person.
   (d)    A person, corporation, firm or other business association acting in the capacity of a contractor and performing more than one type of work as set forth in subsection (a) hereof, shall only be required to register once annually as a contractor regardless of the number and type of work performed.
   (e)    No permit required to be issued by the Division of Building, the Building Commissioner, any other person or by the provisions of any building code shall be issued for work undertaken except to a registered contractor, or as exempted pursuant to subsection (b) or (f) of this section.
   (f)    The provisions of this chapter shall not be interpreted or applied to require registration for officials or employees of Federal, State, County or Municipal governmental agencies or to employees of public utilities who engage in the installation, alteration, repair, maintenance or utilization of any device, appliance, installation or appurtenance forming part of the equipment for generation, transmission or distribution of any commodity or service which such public utility organization is authorized by law to furnish or provide, except that should work covered by the Building Code be contracted to outside concerns, then such contractors shall be registered, as provided herein.
