561.04  PROHIBITIONS AS CONDITION OF EMPLOYMENT; EXCEPTIONS.
   (a)   Any person employed by the City on and after the adoption of this chapter shall be required to refrain from smoking as prohibited herein, and such prohibition shall be a condition of further continuous employment with the City.
   (b)   An employee of the City who has continuously smoked in the workplace for a period of one year or longer prior to the adoption of this chapter shall be permitted to continue such smoking in the workplace, provided, however, that a smoke-abatement device shall be kept in continuous operation at a distance not greater than six feet from the point of smoke exhalation.  The cost of such smoke-abatement device shall be borne by the employee required to utilize the same, and shall be of such size and efficiency as to clear, filter, remove and abate the presence of smoke in and about the workplace of such exempted employee, and shall be approved by the Director of Public Service and Development as meeting the requirements of this section.
