(a) Any City law enforcement officer and/or the Chief of Police, in addition to any other authority vested in him, has the power, upon presentation of proper credentials, to enter and inspect any dwelling, multi-family dwelling, building, structure or premises within the City as may be necessary to enforce the provisions of this chapter, provided permission is obtained from the occupant or, in the case of unoccupied property, from the owner or his agent. If such permission is refused, or is otherwise unobtainable, a search warrant shall be obtained upon the showing of probable cause to believe that a violation of this chapter may exist, before such entry or inspection is made.
(b) At the request of the operator of a passenger vehicle, the officer can administer a stationary motor vehicle noise test. If the officer cannot administer the test at the time of the request, he shall notify the operator when and where the operator may have his vehicle tested. The stationary motor vehicle noise test can provide information as to the extent of defectiveness of the exhaust system or as to whether excessive noise levels were caused by improper operation of the vehicle.
