545.22  SHOPPING CARTS.
   (a)   No person shall remove or cause or permit to be removed from any business property in the City any shopping cart or grocery cart belonging to such business entity unless same is removed by the owner, manager or employee of such business entity for the purpose of transferring parcels to a customer’s vehicle, after which such shopping cart or grocery cart shall immediately be returned to the business property from which it was removed.
   (b)   Any shopping cart or grocery cart found unattended on any public highway, public parking lot or other public property, or any private property other than property owned or leased by the owner of  the cart, is hereby declared to be a nuisance and may be impounded by the City who shall make reasonable effort to notify the owner thereof.  Upon payment by the owner to the City of a service charge of ten dollars ($10.00) per shopping cart or grocery cart, the same shall be released to the owner.  However, if the City returns the shopping cart or grocery cart to the owner’s premises, the service charge shall be fifteen dollars ($15.00).  Any cart not claimed by the owner within sixty days after impoundment shall be forfeited and may be sold by the City to cover expenses, in the manner provided by law.
   (c)   Whoever violates this section is guilty of a minor misdemeanor.
