(a) All commercial trash containers used in the City for collection of garbage, rubbish and other waste materials, must meet the following specifications unless they are kept within a building which is kept locked or secured when employees are not present:
(1) They must be equipped with a rodent proof, tight-fitting cover.
(2) They must be equipped with a lock which may be either of the key type or combination type.
(3) They must be equipped with locking casters mounted on wheels to restrain the movement of the trash containers.
(4) They must be kept in good repair.
(b) The trash containers described in subsection (a) hereof, must be kept locked at all times, except when the container is being loaded or unloaded, filled or emptied.
(c) Any person, firm or corporation, providing a completely fenced area, guarded and/or patrolled on a continuous twenty-four hour basis for the storage of garbage, rubbish and waste materials need not provide locked containers as heretofore provided.
(d) No person shall install, sell, lease or purchase any refuse container that does not conform to the specifications set forth in this section.
(e) In accordance with this section, all newly manufactured or installed refuse containers and all existing refuse containers must meet these safety standards before June 1, 1979.
(f) Whoever violates this section is guilty of a minor misdemeanor for the first offense and a misdemeanor of the fourth degree for each subsequent offense within one year of the first offense. (Ord. 78-44. Passed 1-15-79.)
