513.17  ABUSE OF CONTROLLED SUBSTANCE ANALOGS; PROHIBITIONS.
   (a)   No person shall knowingly do any of the following:
      (1)   By force, threat or deception administer to another or induce another to use a controlled substance analog;
      (2)   By any means, administer or furnish to another or induce or cause another to use a controlled substance analog;
      (3)   Sell or offer to sell a controlled substance analog;
      (4)   Prepare for shipment, ship, transport, deliver, prepare for distribution or distribute a controlled substance analog;
      (5)   Cultivate, manufacture, or otherwise engage in the production of a controlled substance analog;
      (6)   Obtain, possess or use a controlled substance analog;
      (7)   Provide money or other item of value to another person with the purpose  that the recipient of the money or item of value would use them to obtain a controlled substance analog; or
      (8)   Induce, solicit, entice or procure another person to exchange a controlled substance analog for money or other item of value or act or otherwise serve as an intermediary, or otherwise aid or assist in the purchasing or obtaining the controlled substance analog for the offender.
   (b)   This section does not apply to any person who purchases or otherwise obtains a controlled substance analog pursuant to a prescription issued by a practitioner.  This section also does not apply to manufacturers, practitioners, pharmacists, owners of pharmacies and other persons whose conduct is in accordance with Ohio R.C. Chapters 3719, 4715, 4729, 4731 and 4741.
   (c)   The provisions of this section shall not apply to any analog of a drug, compound, mixture, preparation or substance now or hereinafter contained within Schedules I, II, III, IV and V established pursuant to Ohio R.C. 3719.41 and as amended pursuant to Ohio R.C. 3719.43 or 3719.44.
   (d)   Whoever violates this section is guilty of abuse of controlled substance analogs, a misdemeanor of the first degree.
