(a) No child under the age of thirteen shall be upon the streets or sidewalks or any public property or any place open to the public within the City between the hours of 10:00 p.m. and 5:00 a.m. of the following morning. No child under the age of sixteen but of or over the age of thirteen shall be upon the streets or sidewalks or any public property or any place open to the public within the City between the hours of 11:00 p.m. and 5:00 a.m. of the following morning. No child under the age of eighteen but of or over the age of sixteen shall be upon the streets or sidewalk or any public property or any place open to the public within the City between the hours of 12:00 midnight and 5:00 a.m. Monday through Friday and 1:00 a.m. and 5:00 a.m. Saturday and Sunday.
The provisions of this section do not apply to a minor accompanied by his parent, guardian or person in loco parentis having the care and custody of the minor, or where the minor is upon an emergency errand or business trip directed or ordered by his parent or guardian or person in loco parentis having the care and custody of the minor.
(b) No parent or guardian of any child under the age of thirteen and no person in loco parentis having the care and custody of any child under the age of thirteen shall allow such child to be upon the streets or sidewalks or any public property or any place open to the public within the City between the hours of 10:00 p.m. and 5:00 a.m. of the following morning. No parent or guardian of any child under the age of sixteen but of or over the age of thirteen and no person in loco parentis having the care and custody of any child under the age of sixteen shall allow such child to be upon the streets or sidewalks or any public property or any place open to the public within the City between the hours of 11:00 p.m. and 5:00 a.m. of the following morning. No child under the age of eighteen but of or over the age of sixteen or no person in loco parentis having the care and custody of any child under the age of eighteen shall allow such child to be upon the streets or sidewalks or any public property or any place open to the public between the hours of 12:00 midnight and 5:00 a.m. Monday through Friday and 1:00 a.m. and 5:00 a.m. Saturday and Sunday.
The provisions of this section do not apply to a minor accompanied by his parent or guardian or person in loco parentis having the care and custody of the minor, or where the minor is upon an emergency errand or upon a business trip directed or ordered by his parent or guardian or person in loco parentis having the care and custody of the minor.
(c) Any school, church, lodge or other organization, or parent or guardian who desires to hold any entertainment for minors under the age of eighteen years and which entertainment requires such minors to be out at a later hour than that called for in this section shall register in advance in person with the Chief of Police or an officer designated by him to have the minors stay out to this later hour. The application shall state the time the entertainment shall end. The minors who attend this function shall be off the streets or sidewalks or any public property or any place open to the public within the City one-half hour after the function is ended.
(d) The provisions of this section establishing the hours of curfew shall be prominently displayed in all places open to the public.
(e) Any child found in violation of this section shall be taken to the Police Department and the parent, guardian or person in loco parentis shall be notified to come to such Department and take personal charge of this child. The child shall be released only to such parent, guardian or person in loco parentis or to the juvenile authorities.
(f) Any parent or guardian whose child violates this section or any person in loco parentis having the care and custody of any child who violates this section shall be advised in writing of the violation, for the first offense. For a second or subsequent offense, any parent, guardian or person in loco parentis who violates this section is guilty of a minor misdemeanor. Any operator of any place open to the public or any agent or employee of such operator who violates this section shall be advised in writing of the violation for the first offense. For a second or subsequent offense, any operator of any place open to the public or any agent or employee of such operator who violates this section is guilty of a minor misdemeanor. Any child who violates this section shall for a second or subsequent offense be prosecuted in Juvenile Court pursuant to the provisions of Ohio R.C. 2151.022.
