(A) All terms of office for Mayor, Council member(s) and Town Judge shall be for four years.

SPECIFIC OFFICERS AND OFFICIALS
(A) Appointment. The Mayor shall, subject to the advice and consent of the Council, appoint a Clerk-Treasurer who shall hold office for the duration or his or her appointment or until his or her successor is appointed and qualified.

(B) Duties. It shall be the duty of the town’s Clerk-Treasurer:
(1) To receive all moneys that come to the town, either from taxation or otherwise and to pay the same out of the warrant of the Mayor, countersigned by the Clerk, drawn in accordance with law;
(2) To perform such duties in the collection of taxes, licenses or assessments as are or may be prescribed by law or ordinance;
(3) To present at the regular meeting of each month to the Council a full and detailed statement of the amounts of money belonging to the town, received by him or her and by him or her disbursed during the preceding month and the state of each particular fund, which statement must be verified by his or her oath;
(4) To keep the books and accounts of the town in such manner as to correctly present the condition of the finances thereof which must always be open to the inspection of the Mayor, Council or any member thereof;
(5) To keep a separate account of each fund or appropriation and the debits and credits thereof;
(6) To give every person paying to him or her money as Town Clerk, a receipt therefor, specifying the date of payment, the amount and for what paid;
(7) To render at any time an account to the Council, showing the money on hand and the condition of the treasury;
(8) To keep a register of all warrants paid, which must show the date, amount and number and the person to whom and the fund from which the same was paid;
(9) To annually make out and submit to the Town Council at its last meeting prior to May 1, a detailed account of all receipts and expenditures during the past fiscal year and an abstract thereof must be published in the official newspaper;
(10) To pay out, in the order which they are registered, all warrants presented for payment when there are funds in the treasury to pay the same;
(11) To deposit all public moneys in his or her possession and under his or her control, excepting such as may be required for current business, in any solvent bank or banks located in such town, subject to national supervision or state examination, as the Council shall designate and no other;
(12) To attend all meetings of the Council to record and sign the proceedings thereof and all ordinances, bylaws, resolutions and contracts passed, adopted or entered into, and to sign, number and keep a record of all licenses, commissions or permits granted or authorized by the Council;
(13) To record all ordinances, resolutions and bylaws passed and adopted by the Council;
(14) To enter in a book kept for that purpose the date, amount, the person in whose favor and for what purpose warrants are drawn upon the town treasury;
(15) To countersign and cause to be published or posted, as provided by law, all ordinances, bylaws or resolutions passed and adopted by the Council;
(16) To file and keep all records, hooks, papers or property belonging to the town and to deliver the same to his or her successor when qualified;
(17) Prepare and process financial statements as required by state law;
(18) Town Clerk to be Treasurer. Any reference to a “Town Treasurer” in this code shall mean the Town Clerk; and
(19) Perform such other duties as the Town Council may prescribe.

(A) Creation of office. There is hereby created the Office of Town Attorney, to be appointed by the Mayor with the advice and consent of the Town Council.

(B) Duties. It shall be the duty of the Town Attorney to prosecute an defend all suits or actions originating or pending in any court of the state or United States, in which the town is a party, or in which, in the opinion of the Council, the interests or the town are brought into controversy, or in which any of the official acts of any of its officers or agents are involved. When required to do so, he or she shall furnish his or her opinion in writing upon any subject submitted to him or her by the Council or any of its committees. He or she shall draft all ordinances, bonds, contracts, leases, conveyances and such other instruments as may be required by the business of the town, and shall perform all such duties and services in the line of his or her profession connected with the business of the town though not herein specifically enumerated. He or she shall, when requested to do so by the Mayor, attend the meetings or the Town Council or of its committees when requested to do so by the Chairperson thereof. He or she shall prosecute all appeals, writs or certiorari and take all necessary steps in all cases in which the town is concerned, which he or she may deem proper. He or she shall report to the Town Council within 30 days after the adjournment of any term of court of record in which any suit or proceedings may be pending in which the town is a party or interested, the disposition thereof and such other information as, in the opinion of said Attorney, may be of advantage or interest to the town.

(C) Term of office. The Town Attorney shall hold his or her office for a period of two years unless suspended or removed for the neglect, violation or disregard of the duties of his or her office as required by the laws of the state and the ordinances of the town.

(D) Salary set by ordinance. The salary to be paid the Town Attorney shall be set by ordinance.

(E) Salary. The Town Attorney shall be paid the sum of $400 per month, plus the sum of $40 per hour for any hours over ten worked in a month, plus he or she shall be compensated at the rate of $60 per hour for employment in special improvement districts and civil cases wherein suit is filed.
