§ 154.142 H-D HISTORIC DOWNTOWN BUSINESS DISTRICT.
   (A)   The H-D Historic Downtown Business District is established as the centrally located trade and commercial service area within the historically significant downtown business corridor of the community, as established for the National Register of Historic Places. A separate map of this district shall be kept in the custody of the Town Clerk and the Codes Enforcement Officer. At the first available opportunity, the (H-D) historic downtown business district shall be made an integral part of the Fairmont Zoning Map. The regulations of this district are designed to encourage the continued use of land for community trade and commercial service uses, as well as second storey residential usage, and to permit a concentrated development of permitted uses while maintaining a substantial relationship between the intensity of land uses and the capacity of utilities and streets within the context of an historically significant commercial area.
   (B)   The following uses are permitted:
      (1)   Agricultural supplies;
      (2)   Automobile parts and supplies, new, including tire sales;
      (3)   Bakeries, retail;
      (4)   Banks and other financial institutions including loan and finance companies;
      (5)   Barber and beauty shops;
      (6)   Business colleges, barber and beauty colleges, art schools, music and dance studios and similar uses, but excluding industrial trade schools;
      (7)   Business, professional and medical offices;
      (8)   Computer sales and service;
      (9)   Dairy bars and ice cream manufacturing for retail sales on the premises only;
      (10)   Drug stores, with or without fountains;
      (11)   Dry cleaning, laundry pick-up stations and dry cleaning plants having not more than 2,000 square feet;
      (12)   Electric repair shops;
      (13)   Floral and gift shops;
      (14)   Jewelry repair shops;
      (15)   Locksmiths and gunsmiths;
      (16)   Medical and dental clinics and laboratories;
      (17)   Newspaper offices, excluding printing plants;
      (18)   Offices; business, professional and public;
      (19)   Office supplies and equipment, sales and service;
      (20)   Opticians and optometrists, including optical laboratories;
      (21)   Photographic studios and camera supply stores;
      (22)   Printing, publishing and reproduction establishments;
      (23)   Public facilities, including parks and community centers;
      (24)   Radio and TV repair shops;
      (25)   Residential apartments, both owner- and tenant-occupied, on the second floor of a business establishment only;
      (26)   Restaurants, excluding drive-in restaurants;
      (27)   Retail establishments such as department, clothing, fabric, shoe, variety, notion, drug, hardware, furniture, appliance, art goods, floor covering, paint, antique, jewelry, gift, music, toy, sporting goods, book and stationery, magazine, candy, tobacco, pet and hobby and craft stores, but not excluding similar retail outlets;
      (28)   Shoe repair and shine shops; and
      (29)   Tailor and dressmaking shops.
   (C)   Uses not specifically enumerated in division (B) of this section but nonetheless consistent with the general types of businesses so enumerated may be eligible for conditional use permits when authorized under §§ 154.045 through 154.054.
   (D)   Signs are only allowed as follows:
      (1)   Directional signs, directing the public to off-street parking areas, provided not more than 2 signs shall be permitted per lot, provided further that the size of each such sign shall not exceed 4 square feet in area; and
      (2)   Business signs, provided that signs projecting at right angles from the building shall, for on-going business establishments only, be allowed when suspended from above a canopy, provided the sign is at least 15 feet above the sidewalk, otherwise, signs must be mounted flat with building walls and must not project more than 4 inches from the walls. Businesses no longer in operation must remove signs in accordance with §§ 96.57 through 96.60 of this Code.
   (E)   Specifically not permitted within the H-D Historic Downtown Business District are storefront churches and light manufacturing.
   (F)   Within the H-D historic downtown business district as shown on the zoning map, the following dimensional requirements shall be complied with:
      (1)   Area, yard and height requirements shall be provided as required in § 154.162; and
      (2)   Off-street parking and loading shall be provided as required in §§ 154.032 through 154.034.
