§ 154.137  C-B CENTRAL BUSINESS DISTRICT.
   (A)   The central business district (C-B) is established as the centrally located trade and commercial service area of the community. The regulations of this district are designed to encourage the continued use of land for community trade and commercial service uses, and to permit a concentrated development of permitted uses while maintaining a substantial relationship between the intensity of land uses and the capacity of utilities and streets.
   (B)   The following uses are permitted:
      (1)   Alcoholic beverage control stores;
      (2)   Automobile parking lots and structures;
      (3)   Automobile parts and supplies, new;
      (4)   Bakeries, retail;
      (5)   Banks and other financial institutions including loan and finance companies;
      (6)   Barber and beauty shops;
      (7)   Billiard and pool halls;
      (8)   Bus stations;
      (9)   Business colleges, barber and beauty colleges, art schools, music and dance studios and similar uses, but excluding industrial trade schools;
      (10)   Business signs, provided that signs projecting at right angles from the building shall be allowed when suspended from a canopy, provided the sign is at least 8 feet above the sidewalk. Otherwise, signs must be mounted flat with building walls and must not project more than 18 inches from the walls;
      (11)   Dairy bars and ice cream manufacturing for retail sales on the premises only;
      (12)   Drug stores, with or without fountains;
      (13)   Dry cleaning, laundry pick-up stations and dry cleaning plants having not more than 2,000 square feet;
      (14)   Electric repair shops;
      (15)   Fire and police stations;
      (16)   Floral and gift shops;
      (17)   Food stores and meat markets, retail only, but excluding the killing or dressing of any flesh or fowl;
      (18)   Funeral homes and mortuaries;
      (19)   Hotels and inns;
      (20)   Jewelry repair shops and opticians;
      (21)   Launderettes and laundromats;
      (22)   Light manufacturing, as defined in § 154.175; however, this use is not allowed in the Historic Downtown District;
      (23)   Locksmiths and gunsmiths;
      (24)   Medical and dental clinics and laboratories;
      (25)   Newspaper offices and printing plants incidental to offices;
      (26)   Offices; business, professional and public;
      (27)   Office supplies and equipment, sales and service;
      (28)   Pawn shops;
      (29)   Photographic studios and camera supply stores;
      (30)   Printing, publishing and reproduction establishments;
      (31)   Public works and utility facilities, but excluding service and storage yards;
      (32)   Radio and tv repair shops;
      (33)   Restaurants, including drive-in restaurants, provided drive-in restaurants are fenced on all sides which abut residential districts. Fences shall be solid from the ground to a height of 6 feet;
      (34)   Retail establishments such as department, clothing, fabric, shoe, variety, notion, drug, hardware, furniture, appliance, floor covering, paint, antique, art goods, jewelry, gift, music, toy, sporting goods, book and stationery, magazine, candy, tobacco, pet and hobby and craft stores, but not excluding similar retail outlets;
      (35)   Service stations, provided that all gasoline pumps and other stationary equipment shall be located at least 12 feet behind the property line, provided further, that on all sides where stations abut residential districts, a 6 foot high fence and suitable landscaping shall be provided;
      (36)   Shoe repair and shine shops;
      (37)   Signs, directing the public to off-street parking areas, provided not more than 2 signs shall be permitted per lot, provided further the aggregate size of signs shall not exceed 8 square feet in area;
      (39)   Taxicab stands;
      (40)   Telephone and telegraph offices;
      (41)   Theaters, indoor; and
      (42)   Customary accessory uses and structures when located on the same block as the principal structures, excluding, however, open storage.
   (C)   The following conditional uses are permitted when authorized by the Town Board after the Board holds a public hearing. Each request shall be reviewed by the Planning Board for their comments prior to the submission to the Town Board:
      (1)   Mixed uses, i.e., buildings erected for both dwelling and business purposes, provided that buildings shall be furnished with side yards on each side of the building measuring not less than 8 feet in width, provided, however, that this regulation shall not apply to the side street of a corner lot; and
      (2)   Used car and truck sales.

   (D)   Within the C-B central business district as shown on the zoning map, the following dimensional requirements shall be complied with:
      (1)   Area, yard and height requirements shall be provided as required in § 154.162.
      (2)   Off-street parking and loading shall be provided as required in §§ 154.032 through 154.034.
