If such insurance coverage as has heretofore been obtained, or as may be obtained pursuant to the authority set forth in Section 109.02, that may be deemed to exclude an act or omission in the performance of official duties by a court of competent jurisdiction, or if any insurance carrier refuses to provide coverage for any elected official, officer, agent or employee, expenditures from the General Fund shall be made for any and all claims made as contemplated by Section 109.01, and without regard to the period of time in which such official duties were performed. Legal services, under this section, shall be provided by the City Attorney, except wherever the exigencies of City business require, the City Manager shall have the right to employ special counsel to assist the City Attorney.
