1523.02 OPEN BURNING PERMITTED; GENERAL PROVISIONS.
   Unless otherwise subject to a temporary ban, open burning of vegetation grown on the premises of a home or farm by the owner or agent of the owner and small fires set for the purpose of food preparation, or providing light or warmth either contained in a fire pit or similar device or from around which all grass, brush, stubble, or other debris has been removed for a distance of ten feet from the fire may be permitted without having to obtain an open burning permit; provided that consideration is given to the effects of such emission on the air quality of the area affected by such burning and the health, safety, comfort and property of persons are protected from the effects of such burning, and no owner, or agent of the owner shall permit the ash and/or other particulate matter resulting from such burning to escape the premises of such home or farm. Further, should a complaint be received by the Fire Department regarding such burning, and upon investigation by the Fire Chief or his authorized representatives, there is found cause that this is affecting the health, safety, comfort and property of others, or that the ash and/or other particulate matter is escaping from the premises of such home or farm, then the Fire Chief or his authorized representative shall order this open burning extinguished. Should the owner or agent of the owner not comply with such order, then the owner or agent of the owner shall be subject to the penalties provided in Section 1523.99. (Ord. 1707. Passed 9-27-16.)
