(a) The Director, the City of Fairmont, the Board and/or Stormwater Utility shall be obligated under reasonable rules, established pursuant to Section 945.06 of this article, to shut off and discontinue water or sewer services, or both, for failure to pay the fee or charge for the municipal stormwater works and/or stormwater management program, and water or sewer services, or both, shall not be restored until all delinquent fees and charges for the stormwater works and/or stormwater management system, including reasonable penalty charges, and any reconnect fee have been paid in full or upon the execution of a deferred payment agreement approved by the Director or his/her designee.
(b) A reconnection service charge of twenty-five dollars ($25.00) shall be charged.
(c) As an additional remedy, the Director may direct that any appropriate legal action be instituted to collect the unpaid charges, penalties and fees.
