(a) Periodic inspections for compliance with this chapter and the approved SWPPP will be performed by the City Engineer. These inspections do not relinquish the responsibility of the owner to comply with the inspection requirements of the CGP. If it appears that a violation of this chapter has occurred, the owner will be notified of deficiencies or noncompliance in writing. If within twenty-one (21) working days after receipt of the notice, the owner has not rectified the deficiency or non-compliance, or has not received approval of plans for its correction, the deficiency shall be referred to the Prosecuting Attorney or the Ohio EPA for immediate enforcement of this chapter. The Prosecuting Attorney or the Ohio EPA may seek an injunction to cease work immediately until the site is brought into compliance with this chapter. If reasonable efforts to correct the deficiency or non-compliance are not timely undertaken by the owner, the Prosecuting Attorney or Ohio EPA may proceed with civil or criminal legal action.
(b) A final inspection shall be made by the City Engineer to determine if the criteria of this chapter and the approved SWPPP have been satisfied. A notice of completion shall be submitted to the City Engineer by the owner to request and initiate the final inspection.
