(a) On information that there exists any dangerous tree or nuisance tree or part thereof or any nuisance firewood on private or public property, the Service Director may cause notice, via certified mail or express courier service, to be served on the owner, lessee, or agent, tenant, or other person having charge of such land at their last known address notifying them that such dangerous tree, nuisance tree, or part thereof, or any nuisance firewood, must be cut and/or removed within five days after receipt of such notice. In the event that notice is returned undelivered or delivery is refused then notice may be given by publication once in a newspaper of general circulation within the City or posted on the subject property at the discretion of the Service Director. In the instance of unoccupied property or vacant land, the City, in lieu of other notice, may post the property by affixing the notice to the building or in the instance of vacant land posting the same on the land. This notice shall also contain the date of posting, the location of the property and direct that said tree or part thereof or said firewood must be cut and/or removed within five days after receipt or posting of such notice whichever is earlier.
