(a) In the event that it is determined that any tree or part thereof or any firewood from which said samples have been taken, is in fact diseased or infected with the Dutch Elm Disease, Elm Yellows Disease, Oak Wilt, Pine Wilt, Emerald Ash Bore or any other infectious disease or if any said tree or part thereof are dying or no longer producing leaves, fruit or new growth and can no longer sustain itself without potentially causing harm to person or property and/or if any said tree or part thereof or any firewood serve as a breeding place for disease spreading insects, bugs or vectors any said tree or part thereof or any firewood shall forthwith be and it is hereby declared to be a nuisance.
