1424.99   PENALTY.
   (a)   Whoever violates any of the provisions of the Plumbing Code of the State of Ohio, as adopted in Section 1424.01, or fails to comply therewith or with any of the requirements thereof, or erects, constructs, alters or repairs a building or structure in violation of a detailed statement or plan submitted and approved, or of a permit or certificate issued, is guilty of a misdemeanor of the fourth degree and shall be fined not more than two hundred fifty dollars ($250.00) or imprisoned not more than thirty (30) days, or both. A separate offense shall be deemed committed each day during or on which a violation or noncompliance occurs or continues after notification of such violation or noncompliance.
   (b)   The owner of a building, structure or premises where anything is in violation of the Plumbing Code of the State of Ohio shall be guilty of a misdemeanor of the fourth degree and shall be fined not more than two hundred fifty dollars ($250.00) or imprisoned not more than thirty (30) days, or both. A separate offense shall be deemed committed each day during or on which a violation or noncompliance occurs or continues after notification of such violation or noncompliance.
   (c)   The application of the penalty provided in subsections (a) and (b) hereof shall not be deemed to preclude the enforced removal of prohibited conditions or the application of any other equitable remedy.
