(a) No person shall construct a driveway approach or downspout outlet without first obtaining a curb cut or downspout outlet permit therefor from the Director of Public Service and paying the fee for the same.

(b) Curb cuts for driveways shall be permitted to provide for a driveway entrance not to exceed thirty (30) feet in throat width. All commercial driveway approaches shall flare seven (7) feet on each side of the throat.
(c) No permit shall be issued for a curb cut exceeding forty-four (44) feet in length unless the Street Commissioner first certifies in writing to the Director of Public Service that:
(1) A need exists for a longer curb cut by reason of either unusual physical conditions or the nature of the business or operation on the abutting property;
(2) The longer curb cut desired does not impair the public interest, safety or convenience;
(3) The desired curb cut will not adversely affect the rights of adjacent owners or tenants.
(d) The location of any curb cut shall be with the approval of the Director of Public Service for reasons of public safety.
(e) In locations where there are no storm sewers or storm sewer underdrains present, downspout outlets not exceeding three (3) inches in diameter may be core drilled through the curb upon the approval of the Director of Public Service.
(f) All unused drop curb areas shall be filled in by full replacement in accordance with the City of Fairlawn Materials and Construction Standards 2003 Edition as amended.
