(A) The open burning of landscape waste is only allowed on the premises on which such landscape waste is generated.
(B) (1) The burning of landscape waste only during the months of March 1 through May 15, September, October, November and December of each year in the area outside the central business district on private property, and not on any public street, sidewalk, alley or right-of-way, during the hours from sunrise to sunset; and
(2) Any burning of landscape waste at sunset shall be immediately extinguished by the person setting the fire.
(C) Before a landscape waste fire is set, the property owner or his/her designee must have a means of extinguishing the fire available for immediate use. Such means of extinguishment shall either be a 4-A functional fire extinguisher or a functional garden hose with a working and functional water spigot.
(D) The landscape waste fire must be attended to and monitored at all times.
