§ 94.002 OPEN BURNING UNLAWFUL; EXCEPTION.
   (A)   No person shall cause or allow open burning in the restricted area except as hereinafter provided.
   (B)   No person shall cause or allow the burning of any refuse in any chamber or apparatus unless the chamber or apparatus is designed for the purpose of disposing of the class of refuse being burned.
   (C)    No person shall light or maintain any fire in the restricted area, which is so close to any building or structure, or any flammable material (other than that to be burned), so as to cause a fire hazard.
   (D)    No burn barrels are permitted to be used for any open burning within the restricted area, except that a barrel may be used for firefighter training purposes.
   (E)   All open burning fires must be extinguished at the request of any law enforcement official, any firefighter employed with the City of Fairfield Fire Department or any city official or their designee.
   (F)   Open burning shall be allowed only if atmospheric conditions will readily dissipate contaminants.
   (G)   Open burning is not allowed if it creates a visibility hazard on roadways, railroad tracks or
air fields.
   (H)   The setting of fires to combat or limit existing fires when reasonably necessary in the judgment of the responsible government officials shall not constitute a violation of this subchapter.
   (I)   Open burning for which a permit has been obtained from the Pollution Control Board and is valid on the date of the burning shall not constitute a violation of this subchapter.
