733.03 RECORDS OF TRANSACTIONS.
(a) Every secondhand dealer operating or conducting business within the City of Fairfield corporate limits shall require valid government issued photo identification from all persons with or from whom the secondhand dealer purchases, exchanges, trades or receives secondhand articles.
(b) Every secondhand dealer operating or conducting business within the City of Fairfield corporate limits shall record and maintain each transaction through a computer data system as stipulated by the Fairfield Chief of Police. Each transaction record must include:
(1) The name, date of birth, address, and telephone number of the seller. If the sale of the secondhand article is conducted by an agent of the property owner, the person acting as agent must disclose the name, date of birth, address, and telephone number of both the property owner and the agent;
(2) The type of government issued photo identification used to verify the identity of the seller, together with the name of the governmental agency that issued the identification, and the identification number present on the government issued identification. A legible photo copy of the identification must be recorded and maintained;
(3) The name, address, and telephone number of the secondhand dealer;
(4) The date of the transaction;
(5) The amount of the transaction;
(6) For the article or articles pledged, a detailed description of the articles to include brand names, model numbers, manufacturer’s serial numbers, initials or words inscribed on the article, or any other identifying marks or information.
(c) Electronic or computerized data must be preserved by the business on the business premises for a period of two (2) years from the date of the transaction. Every secondhand dealer shall submit to the Fairfield Police Department each business day all required data set forth in subsection (b) regarding all transactions conducted by the secondhand dealer during the preceding twenty-four (24) hour period of operation.
(d) All books, forms, accounts, electronic data, and records, and all other sources of information with regard to the business of the secondhand dealer licensee, shall be available for inspection at all times by the Chief of Police or any police officer for the purpose of assuring that the business of the secondhand dealer licensee is being transacted in accordance with law and the requirements of this chapter.
(e) Secondhand dealers must retain all secondhand articles which the secondhand dealer obtains by purchase, exchange, trade or receiving for a period of at least three days, not including Saturdays, Sundays or holidays after the transaction record has been electronically transmitted to the Fairfield Police Department in accordance with subsection (c) hereof before any such articles or goods may be disposed of or sold. Such secondhand articles shall be maintained in the same condition in which they were obtained by the secondhand dealer during such three day period.
