521.13   NOISE CONTROL.
   (a)   Offensive Conduct of Business In a Public Place.
(1)   No person shall call out or attempt to purchase, sell or dispose of any article or pursue any business, upon any public sidewalk, street or public place in an offensive manner.
(2)   No person shall solicit any trade or business in an offensive manner on any sidewalk or street or conduct any trade, business or calling upon any premises adjacent to any sidewalk, street or public place in an offensive manner.
(3)   No person shall conduct any such business, trade or calling for any other person.
   (b)   Nighttime Operation of Noisy Business in Residence Area. No person shall keep open or operate any factory, plant or business between the hours of 10:00 p.m. and 6:00 a.m. in which machinery or other instruments are used which produce loud or disturbing noises, in a residence block or square bounded by three or more public streets, in which more than sixty percent (60%) of the surface area is owned or used for residential purposes.
   (c)   Whistles.
(1)   No railroad or any agent or employee of any railroad shall blow or sound any locomotive whistle, or other steam whistle, within the corporate limits.
(2)   The provisions of this subsection shall not be construed so as to prevent the blowing or sounding or any locomotive whistle in case of immediate danger, or of the blowing or sounding of any steam whistle when it may be necessary, in notifying employees of factories of the time of commencing and stopping work.
   (d)   Noise Near Hospitals. No person shall emit or cause any loud noise within one hundred fifty feet from the outer lines of the building or grounds of any hospital.
   (e)   Sounding Instrument to Gain Business. No person shall use or cause to be used any bell or other instrument, as a means of attracting people to an auction or other place, or to gain passengers for any carriage, cab, hack, coach or omnibus, or other vehicle. (Ord. 31-59. Passed 8-30-59.)
   (f)   Penalty. Whoever violates this section is guilty of a misdemeanor of the second degree.
