303.99   GENERAL TRAFFIC CODE PENALTIES.
   (a)   General Misdemeanor Classifications. Whoever violates any provision of this Traffic Code for which violation no penalty is otherwise provided, is guilty of a minor misdemeanor.

   (b)   Penalties. Whoever is convicted of or pleads guilty to a violation of this Traffic Code shall be imprisoned for a definite term or fined, or both, which term of imprisonment and fine shall be fixed by the court as provided in this section.

(c)   Community Service. Upon the motion of any person who is convicted of or pleads guilty to a violation of this Traffic Code, the court may in its discretion require that person to perform supervised community service work under authority of the City in lieu of imprisonment or the payment of a fine or the payment of court costs, or any combination thereof. The following do not control the court's discretion, but shall be considered in favor of allowing an offender to perform supervised community service work:
      (1   The offense did not cause property damage or personal injury to others.
      (2)   The offense was the result of circumstances unlikely to recur.
      (3)   The offender has no history of prior Traffic Code violations or criminal activity, or has led a law abiding life for a substantial period before commission of the present violation of the Traffic Code.
      (4)   The character and attitude of the offender indicate that he is unlikely to commit the same or a similar Traffic Code violation.
      (5)   Imprisonment of the offender will entail undue hardship to himself or his dependents.
   Supervised community service work under this section shall not be considered a suspension of sentence.
