145.07 REINSTATEMENT OF FIRE CHIEF.
Notwithstanding the provisions of Ohio R.C. 124.50 and any other sections of the Ohio Revised Code, the ordinances of the City of Fairfield, Ohio and the rules of the Fairfield Civil Service Commission, the following shall be the procedure for the reinstatement of the Fire Chief:
A person holding the position of Fire Chief in the fire department who resigns therefrom without delinquency may be reinstated to the position of Fire Chief upon the filing of a written application for reinstatement with the City Manager. Such reinstatement must occur within ninety (90) days after the date of resignation. The reinstatement to the position of Fire Chief includes full seniority for previous service in calculating eligibility for City benefits including, but not limited to, longevity pay. Salary will be determined by the Council and City Manager in accordance with City ordinance. The payment of any accumulated sick and vacation leave upon resignation of the Fire Chief shall be deferred for a period of ninety (90) days after the resignation. If the Fire Chief is reinstated as provided herein, such accumulated sick and vacation leave shall be retained by the Fire Chief but payment therefor shall not be made until subsequent separation from the service of the City by the Fire Chief and will be made in accordance with then current ordinances of the City at the then current salary rate of the Fire Chief. If the Fire Chief is not reinstated as provided herein, the payment of accumulated sick and vacation leave shall be made as soon as practicable after the ninety (90) day period after the resignation has elapsed and shall be paid at the salary rate of the Fire Chief at the time of resignation. No reinstatement of any Fire Chief under this section shall occur after June 1, 2011.
